There are plenty of decisions that must be made during any divorce. In the state of Illinois, an uncontested divorce is one in which both spouses have agreed upon a plan for these decisions, including money, debt, parenting time, and division of personal items. 


My role as a mediator is to help couples reach that very goal. 


During an uncontested divorce, agreement on all issues is necessary. Additionally, an uncontested divorce filing must be a complete, properly drafted Marital Settlement Agreement.


An uncontested divorce is when:

  • Everyone is willing to sign all documents,

  • Both spouses desire to be single,

  • Both spouses agree on division of property,

  • Both spouses agree upon the parenting time and decision making,

  • The exact amount of child support is agreed upon,

  • The subject of alimony is not in dispute, AND

  • All other issues are settled

Divorce mediation is the best way to reach a marital settlement agreement in an uncontested divorce. This does not mean there will not be disagreements in the mediation process. But it does mean that both spouses have a desire to resolve all the issues pertaining to money and parenting.

Divorce mediation lets you remain in control of your life and the decisions that need to be made in an uncontested divorce. Judges appreciate when a couple can come to their court date having agreed upon all issues related to the divorce. This makes the proceedings go much smoother.  

Traditional divorces (when attorneys litigate) can be stressful and expensive.  During a divorce mediation of an uncontested divorce, it is designed to be less stressful and much more reasonable in cost.
