Why is Divorce Mediation Preferable Over Litigation?

When it comes to divorce mediation, you might have some questions. One major question you might wonder is — why is mediation preferable over litigation?

In order to answer that question, it’s helpful to ask yourself — who should be making decisions about your life? Attorneys? A judge?

In most aspects of your life, you are the best person to make decisions about your own life. From a psychological perspective, virtually all of life’s major challenges are difficult because we feel we have lost a sense of control.

Divorce mediation allows you and your spouse to have the most influence over decisions that must be made in your divorce. Although it is necessary that you compromise as part of the mediation process, divorce mediation gives you the most control over what is happening as it pertains to your divorce. This helps you feel less anxious and overwhelmed during the process.

Decisions must be made one way or another. These decisions are difficult — but they’re also necessary. Mediation allows for civil discussions and thoughtful decisions as they relate to your family.

While divorce mediation has many upsides, mediation is not appropriate for every couple. If either party is intent on hurting one another or unable to listen to reason, mediation is unlikely to be successful. In those cases, divorce attorneys will be happy to step in and do the dirty work.

At Peaceable Divorce, it is my belief that mediation allows for the parties to remain civil and maintain the most control over their lives.  We Service Chicago and surrounding areas including Libertyville, Forest Lake and more.
